These Terms and Conditions of the MyHomeGuest.com Portal and the related agreement on the contractual terms stipulated through the technical interface on the portal, which govern the relationship between the owners of real estate units intended for short-term rentals and AlfCam Srls, with registered office in Quaru Sant\u2019Elena (CA) at Via Gennargentu, 7, CAP 09046, VAT number 04168730929, Economic and Administrative Code CA368957 (hereinafter AlfCam Srls), constitute an agreement relating to the publication of holiday homes and in general of real estate units intended for short-term rentals of a non-professional nature.<\/p>

Definitions and premises<\/p>

GUEST: A user of the MyHomeGuest.com website looking for short-term accommodation who has made a booking through MyHomeGuest.com from the property listing managed independently by the Host.<\/p>

HOST: a natural person who owns a maximum of two real estate units and does not have a VAT number, who lists his\/her property(s) on MyHomeGuest.com for short-term rentals.<\/p>

PROPERTY DETAILS: The detailed description of the property entered by the Host on MyHomeGuest.com, with photographs and all types of specific information about the property, including prices for short stays, managed directly by the Host.<\/p>

Account Registration. To have Offers listed on MyHomeGuest, the Host must register online and complete all the necessary information for publication. After paying the annual fee of \u20ac250.00, a live call via Google Meet will be scheduled between a MyHomeGuest representative and the Host. Each Host may have only one registered account on MyHomeGuest and a maximum of two properties. By completing the registration process, the Host accepts the terms and conditions of the service. During the registration process, the Host and AlfCam Srls agree on the details of the fee, the rental terms for the property, and the invoicing process. Once accepted by both parties, the registration is binding and cannot be cancelled, except as provided in this agreement.<\/p>

MyHomeGuest will verify the existence and proper registration of the properties listed in accordance with current regulations, paying particular attention to the property\u2019s registration with the Ministry of Tourism with the relevant CIN code (mandatory for listing), as well as the accuracy of the information entered by the Host. Should any irregularities be detected, MyHomeGuest reserves the right to block, suspend, and, in the worst case, deactivate the account if the irregularities are not remedied within a reasonable period of time.<\/p>

MyHomeGuest will request all documents from the Host that serve as proof of identity and ownership of the property. If the Host refuses or delays in providing these documents, MyHomeGuest.com reserves the right, at its sole discretion, to withhold the visibility of the property listings published by the Host or to limit the Host\u2019s ability to complete reservations, receive inquiries, and generally interact with guests.<\/p>

All information provided by the Host during registration on MyHomeGuest.com must be truthful and accurate. To this end, the Host must guarantee the authenticity and truthfulness of all data provided when completing the forms required to register for the Services.<\/p>

It is also the Host\u2019s responsibility to keep their contact information up-to-date and accurate. The Host will be solely responsible for any incorrect information that may harm guests.<\/p>

The Host has the right to withdraw from the contract by sending an email to AlfCam Srls provided during registration, certified email (PEC), or registered mail within 10 days of paying the annual fee. After this 10-day period, the contract will remain in effect until renewal.<\/p>

By registering an account, the Host declares under his\/her own responsibility that he\/she is entitled to receive the proceeds from the rental of the property directly into his\/her bank account or PayPal account.<\/p>

The data required by the Host includes property features, text, images, prices, payment and cancellation details, availability, and the CIN code. All data must be entered correctly on MyHomeGuest and is the Host\u2019s sole responsibility.<\/p>

The Host must comply with all national, local, or municipal requirements, acts, rules, and other laws and regulations applicable to rentals, brokerage, and the listing of properties on MyHomeGuest, as well as any other platform. Should any administrative body require a permit or license for the property to be used for short-term rental purposes, the Host will ensure that all legal requirements are met for their Offers. The Host guarantees and assumes full responsibility for ensuring that the rental price is up to date and remains unchanged until the booking is confirmed.<\/p>

The Host is solely responsible for all activities conducted through the account and password used for the Services and the property listing.
The Host may use the so-called iCal function, a file format that allows you to create and share electronic calendars, to synchronize the Platforms with other sites or platforms (booking, Airbnb, etc.).<\/p>

MyHomeGuest will use the Host\u2019s communication channels provided during account registration for any communication with the Host regarding the relationship with MyHomeGuest. MyHomeGuest provides hosts with a communication tool to communicate, including via chat, directly with Guests interested in booking properties.<\/p>

j. Rental Agreements. The contractual relationship with the Guest (e.g., rental agreements) underlying each reservation generated through a Host Offer is stipulated directly between the Host and the Guest who booked the property. All external transactions with the Guest must be carried out by the Host. MyHomeGuest.com collects and transmits to the Host the data relating to the Guest\u2019s request or reservation on behalf of the Host. The Parties acknowledge that MyHomeGuest uses third-party service providers, particularly with regard to the collection and forwarding of payment information, and, in particular, the Host is willing to enter into separate agreements with such service providers and\/or between the Parties to the extent required (PayPal, Stripe, etc.).<\/p>

Guests can provide ratings and reviews for Offers booked on MyHomeGuest. MyHomeGuest is not responsible for the content of Guest reviews, but reserves the right to conduct appropriate checks before publishing reviews that violate the law or any other applicable policy.<\/p>

When registering an account, the Host can choose a default cancellation policy for Guests and can change it later. The Guest cancellation policy applies to all reservations for Host Offers and is binding on both the Host and the Guest for each reservation.<\/p>

All reservations for which payment has not been made by bank transfer or credit card are not subject to these cancellation conditions.<\/p>

3. Rights and Obligations of AlfCam Srls
Subject to the Host\u2019s receipt of all fees and compliance with this Agreement, MyHomeGuest will allow the listing and management of properties on MyHomeGuest.com for the purpose of entering into rental agreements with guests.<\/p>

The Host Offer must be unique and different from other offers on MyHomeGuest.com. Duplicating an offer for a single property is not permitted, so each Offer can only refer to one property. The Offer must correspond to a real property and cannot simply be a sample of properties in a specific area.<\/p>

For the services provided by MyHomeGuest under this Agreement, the Host will be charged a fee of \u20ac250.00 for each calendar year of listing for each property listed.<\/p>

Payment for the Subscription must be made in advance and, subsequently, upon each renewal. The Host is obligated to make all payments on time, in accordance with these terms and conditions, which state that receipt of payment is decisive.<\/p>

The Host will receive an invoice from AlfCam Srls in accordance with legal regulations.<\/p>

Receipts for reservations made will be managed directly by the Host with the guests, as the relationship is direct and never intermediated by MyHomeGuest.com.<\/p>

AlfCam Srls and the Host undertake to comply with all applicable data protection regulations in Italy and Europe (GDPR) and will use the data transmitted only in accordance with these regulations. The parties have undertaken in writing to comply with all applicable data protection regulations. The Host implements and maintains an adequate and appropriate level of technical and organizational security measures, at least with the same level and degree of care it uses to protect its own data (not less than reasonable diligence).<\/p>

This Agreement is governed by Italian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
